Terms of Service

1Who we are and what these Terms cover

Pasapot is a digital passport for real places. The Pasapot app, the website pasapot.com, the partner portals at artist.pasapot.com and spot.pasapot.com, and the services around them (together, the “Service”) are provided by Pasapot, a company established in Ho Chi Minh City, Vietnam (“Pasapot”, “we”, “us”).

By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal data. If you do not agree to these Terms, please do not use the Service.

Artists, spots and brands who join our programs also sign a separate partner agreement. For that partnership, the partner agreement applies where it differs from these Terms.

2Who can use Pasapot

You need to be at least 16 years old to use Pasapot on your own. If you are younger, you may use Pasapot only with the consent of a parent or legal guardian, who accepts these Terms for you and is responsible for your use of the Service.

If you use Pasapot for a business, such as a spot or a brand, you confirm that you are allowed to act for that business, and these Terms bind the business too.

3Your account

You sign in with a supported provider, such as Apple, Google, Facebook, TikTok, LINE or Zalo. We receive the basic details described in our Privacy Policy.

• Keep one personal account, and keep your sign-in secure. You are responsible for what happens in your account.
• Keep your details accurate. Do not use someone else’s name or pretend to be a spot, an artist or Pasapot.
• If the law requires us to verify accounts, for example with a phone number, we may ask you to do so before you can use some features.
• If you think someone else is using your account, write to [email protected] straight away.

4Check-ins, stamps and arts

When you are inside a spot’s area, the app offers a check-in. A check-in uses your device’s location and a live photo taken in the app at that moment. A successful check-in puts the spot’s stamp in your passport. Some check-ins also unlock an art or a perk.

Stamps, arts, collections, badges and passport covers are digital collectibles for your personal enjoyment inside Pasapot. They have no cash value. They cannot be sold, transferred or exchanged for money, and they are not cryptocurrency, NFTs, securities or stored value.

• The rules for collections and seasons, such as how often a spot counts, are shown in the app and may change from one season to the next.
• We may add, change, retire or re-release stamps, arts and collections. If a spot leaves Pasapot, the stamps you already collected stay in your passport.
• Location accuracy depends on your device and network, so a check-in can sometimes fail. If that happens, tell us and we will look into it.

5Play fair

Collections only mean something if everyone earns them the same way. So please do not:

• fake or simulate your location, or use emulators or other tools to trick a check-in;
• use photos that are not taken live at the spot, including photos of screens or other photos;
• use more than one account, bots or scripts, or buy, sell or trade accounts or collectibles;
• misuse perks, for example by showing a screenshot instead of the live perk screen.

We check for unusual activity. If we find cheating, we may remove the stamps, arts or rewards involved, limit features or suspend the account, as described in section 13.

6Spots and perks

Spots are independent businesses. Each spot decides its own perks, conditions, opening hours and prices, and is responsible for the quality and safety of what it sells. Pasapot does not sell the spots’ food, drinks, goods or services.

• Perks are offered by the spot. They may be limited in number, change or end, and have no cash value. A spot may decline a perk if its conditions are not met.
• If something goes wrong with what a spot sold you, please raise it with the spot. You can also tell us, because we review every spot on Pasapot.
• Spot details such as addresses and hours can change. Check before you go.

Stay safe while you explore: watch the road, do not use the app while riding or driving, and respect the places and the people in them.

7Your content

Your check-in photos, notes, memories, profile details and messages are your content. You keep ownership of them.

Your check-in photos and memories are private by default. They are only shown to others when you choose to share them, for example by sharing a passport page.

You give Pasapot a non-exclusive, worldwide, royalty-free licence to store, process, display and adapt your content (for example, resize a photo) only as needed to run the Service. That includes showing it to the people you choose to share it with and checking check-ins for cheating. We will not use your photos in advertising without asking you first.

The licence ends when you delete the content or your account, except for copies that others already received from you, or that we must keep by law.

Only post content you have the right to post. If people can be recognised in your photo, make sure they are happy to be in it.

8Artists’ work and our content

Stamps and arts are made by artists, and the copyright stays with them. Artists license their work to Pasapot so it can be shown in the app and in the spots’ promotion. Collecting a stamp or art lets you view and share it with Pasapot’s sharing features. It does not let you copy, print, sell or use it commercially outside Pasapot.

The Pasapot name and logo, Pa our mascot, and the design and software of the app and websites belong to Pasapot or its licensors. Please do not copy them, or decompile or reverse engineer the software, except where the law allows it.

If you believe something on Pasapot infringes your rights, write to [email protected] with the work, where it appears on Pasapot, and how to reach you. We review every report and remove content that infringes.

9Tips, purchases and payments

• Tips. You can tip an artist from their profile. Tips are voluntary and go to the artist. Pasapot does not take a share of tips. A payment method may charge a fee, and you see it before you pay. Once sent, a tip cannot be refunded, except for a payment error, an unauthorised payment, or where the law requires a refund.
• Prints and drops. When these are available, each listing shows the price, what you get, delivery or pickup, and the return and refund terms. Your consumer rights apply.
• Payment providers. Payments are processed by payment providers, such as banks through VietQR, MoMo and card processors. Their terms also apply to your payment. We do not store your full card number.
• Prices. Prices are in Vietnamese dong unless shown otherwise, and include the taxes that apply unless stated.
• Commissions. If you contact an artist directly for a commission or a collaboration, the arrangement is between you and the artist. Pasapot is not part of it.

10Sponsored collections

Some collections and placements are sponsored by brands, tourism boards or events. We always label sponsored content. Sponsors receive campaign totals, such as verified visits and completed collections, not your personal data. We do not sell your personal data.

11Acceptable use

When you use Pasapot, do not:

• break the law, including the laws of Vietnam, or help anyone else do so;
• post content that is illegal, hateful, harassing, sexual, violent, misleading, or that shares someone else’s personal information without their consent;
• infringe anyone’s copyright, trademark, privacy or other rights;
• send spam, or use the Service for commercial purposes that we have not agreed to;
• interfere with the Service, try to get around its security, or collect data from it by automated means.

We may remove content that breaks these rules, and report it to the authorities where the law requires.

12Changes to the Service

Pasapot is new and still growing. We may add, change or remove features, spots, cities and collections, and some features may be marked as a preview or beta.

We work to keep the Service running, but we cannot promise it will always be available or free of errors. If we ever close the Service, we will give you reasonable notice and, where we can, a way to download your photos and passport.

13Suspension, termination and deleting your account

You can delete your account at any time in the app settings, or by writing to [email protected]. Deleting your account removes your passport, photos and memories as described in the Privacy Policy, and collectibles cannot be restored afterwards.

We may suspend or close an account, or remove content, if someone seriously or repeatedly breaks these Terms, cheats, puts other people or the Service at risk, or if the law requires it. Where it is reasonable, we will tell you why and give you a chance to respond. You can ask us to review a decision by writing to [email protected].

The parts of these Terms that by their nature should continue after an account ends, such as licences already granted, liability and disputes, continue to apply.

14Disclaimers

As far as the law allows, the Service is provided “as is” and “as available”. We do not guarantee that spot information is always up to date, that a perk will be available, or that check-in will work in every place and on every device.

Nothing in these Terms takes away rights you have as a consumer that cannot be limited by law.

15Limitation of liability

As far as the laws of Vietnam allow:

• we are not liable for indirect or consequential losses, such as loss of profit or opportunity, or for the acts of spots, artists or other users;
• our total liability for all claims about the Service is limited to the greater of the amount you paid to Pasapot in the 12 months before the claim and VND 2,000,000.

These limits do not apply where the law does not allow them, including liability for death or personal injury caused by our fault, or for our intentional wrongdoing.

16Governing law and disputes

These Terms are governed by the laws of Vietnam.

If you have a problem, please write to [email protected] first. Most problems can be solved this way, and we aim to reply with a proposal within 30 days.

If we cannot solve it together, the dispute may be brought before the competent court in Ho Chi Minh City, Vietnam, or another court that has jurisdiction under the law. As a consumer, you may also use any other way of resolving disputes that consumer protection law gives you, such as mediation or a complaint to a consumer protection authority.

17Language

These Terms are written in Vietnamese and English. If the two versions differ, or we provide another translation that differs, the version that is more favourable to you as a consumer applies.

18Changes to these Terms

We may update these Terms when the Service or the law changes. For important changes, we will tell you in the app or by email at least 14 days before they take effect. If you do not agree, you can stop using the Service and delete your account before the change takes effect. The date at the top of this page shows when these Terms were last updated.
